We do so. plus For our upcoming second Sim all pre-orders receive the owner version from torgons profiler for free. FelineS KittyCatS wants to spread them on the Grid, so we Gift them to all new TenantS.

I would ban Rene too from FelineS but as Kiki mentioned: If we do so Tenants might be affected by getting banned using the Profiler from Rene. So we do not ban him (yet). But Rene is also known for his unfair game. So i kinda wait for that day -.-

Thankyou for the words of support, Julia and also it is really great what you are doing to offer a free Torgon's profiler to new tenants so they have their very own to use as they want and own for themselves ^.^

I totally understand why market owners are in a difficult position and cannot for now ban him because it would affect the tenants who use RM.

It is important to see that it is just is another lie for him saying it is a few people who feel as we all do. It's not at all! FelineS do not support him. Too Adorable does not support him. Kat Shack does not and promotes Torgon's too. Other markets also do not support him. But we are meant to believe the lies that it is a handful of people who are his 'problem'. Not true! He now has most major market owners not supporting him, and there is a very good reason why they are not because they are good people who support our community and believe in fairness and not bullying =)

So now he is saying I am lying on the Marketplace for my honest reviews but my comments have not been removed because I was careful to stick to facts ^.^

His listings now show a link to his terms which was not there before, which is something, but still not exactly honest as he could just paste the words there or actually be an honest person and say if you use any other type of profiler I will ban you, clearly saying it before someone buys.

He still uses the KittyCats images shown on profilers which is not true at all. Those images are old and bogus. He has not had permission to ever use those and is fully aware he cannot, yet continues to violate the copyright.

I'm also curious for anyone who knows this stuff, as I do not, but how valid is it to sell on Marketplace and link to a secondary site for the terms? Also, how valid are these terms of use when the buyer never actually has agreed to them anywhere?

Dunno about linking to external terms rather than putting them on the marketplace. That's up to LL and their ToS. I don't think the want it, but I'm not sure they disallow it.

Whether the terms are enforceable depends on which court you go to. As I understand it some say yes, some say no, and many have not been asked. Basically, I'd say they're enforceable until on of you has had enough, files a lawsuit, and wins with the decision striking down his terms.

The term in question, of course, is not his right to ban copyright and trademark violations. That's actually implicit: he has that right without stating it. No, it's does he have the right to ban sorta-the-same-but-not-copies and that's really a patent claim, which he does not have. Any of you harmed by his actions might have a case against him. The one who clearly does is Torgon because his false claims are clearly an attempt to restrict trade which is only legal if you have a patent. But, again, whatever he does, it does not matter if it's legal until one of you files a lawsuit.

He has no right to use those images which show the KittyCat on the profiler, and is perfectly aware he can't, does not own them, did not create them and that they are copywritten. Absolutely aware without a doubt

I read your reviews, Minx. It is nonsense to claim you are lying. Any person with his profiler can prove he is lying by listing their cat there. Do you see a pretty cat picture or a blank background with text? Case closed, it is obvious who is dishonest. I do not understand why marketplace allow something to be sold which is not at all as represented. He only added the links to his site recently, so it was not lies to say he did not have them, as he did not at that time. The images he uses clearly show use of the copywritten kitty images which the profilers do not even show anyway. Really, what he does is comparable to selling a dress with gorgeous embellishments which make it attractive, only to receive a plain black version with a couple of stripes on. Worse yet, the embellishments are copywritten content which were used on product images to dupe me into buying it, but are none existent, in reality. Better yet, is that the creator of this dress wishes to invite himself to my home, go through my closet and have a childish hissy fit then bully me when he sees I own dresses by other designers, and refuse to remove them

I wish he would quit harassing people and actually put effort into instead taking a basic, simple business class where he might actually learn about concepts such as copyright. He has no clue for any fundamental aspect of business

The sad truth is that this man believes he is right and everyone else is wrong so he will never ever stop, its unlikely his MP Listing will be amended unless Callie actually puts in a report regarding the images, when I flaggd the item I was sad to see that, unlike abuse reports filed inworld, there wasn't a comments section where we could point out that the actual profilers do not show images as represented in the listing, and I doubt LL will take the time to ask any of us why the product is not as described.

TBH the products will speak for themselves. Torgon's profilers always gets updated when we find new traits, and they have great customer support, and they are more affordable! So in my perspective, the win is to use/buy/support Torgon. I found it really hilarious that Rene's website has this statement LOL.



It's a very hypocritical to say the least.
